What The BELA Act Is All About

The Basic Education Laws Amendment (BELA) Act is a proposed law in South Africa to update the South African Schools Act (SASA) and the Employment of Educators Act. It introduces several key changes to the basic education system.

“Minister Gwarube assured committee members that the BELA Act will be implemented explaining that it is impossible for a Minister not to implement an Act that has been enacted into law.”

Key Aspects of the BELA Act

  1. Compulsory Grade R – The Act makes Grade R (Reception Year) compulsory for all children, meaning school attendance will be required from Grade R rather than Grade 1.
  2. Changes to Language & Admission Policies – The Act grants provincial education departments greater control over school language and admission policies, diminishing the authority of school governing bodies (SGBs).
  3. Homeschooling Regulations – Parents will now need to register their children for homeschooling with the provincial education department and adhere to a prescribed curriculum.
  4. Stricter Penalties for School Absenteeism – Parents who fail to ensure their children’s school attendance may face fines or imprisonment.
  5. Prohibition of Corporal Punishment – The Act reinforces the prohibition of corporal punishment in schools and imposes penalties for violations.
  6. Regulation of Initiation Practices – Harmful initiation practices, such as hazing rituals, will be strictly prohibited.
  7. Alcohol on School Premises – The Act allows alcohol to be consumed on school premises for non-school-related events under strict regulations.
